Preamble
The Tourist Offices (hereinafter referred to as “TOs”), the Agence d’Attractivité de la Manche (hereinafter referred to as “Attitude Manche”) and the Comité Régional du Tourisme (hereinafter referred to as the “CRT”) are responsible for promoting tourism and, to this end, encouraging the dissemination of tourist information relating to their area of responsibility. Since 2009, in the Manche department, Attitude Manche and the Tourist Information Centres have been jointly supplying the Manche Tourist Information System (hereinafter referred to as “SIT50”).
The SIT50 is a tourism database that lists accommodation, leisure activities, shops and services, associations and other organisations and contacts linked to tourism activities. The SIT50 is used to respond to all requests for tourist information from the general public and professionals, both before and during their stay, and also to promote tourism in the Manche department. It is therefore the source :
- several paper editions from certain tourist offices.
- the websites of Attitude Manche and certain tourist offices.
- CRT websites.
It is therefore a commercial advantage to be listed in it and to keep your information up to date.
The SIT50 is updated throughout the year by Attitude Manche, the tourism service providers themselves, Labels Manche (grouping together the Relais Gîtes de France and Clévacances de la Manche), and also by certain tourist offices, namely :
- Granville Terre et Mer Tourist Office
- Cotentin Tourist Office
- Côte Ouest Centre Manche Tourist Office
- Saint-Lô Agglo Tourist Office
- Villedieu-les-Poêles Tourist Office
- Tourist Office Mont Saint-Michel Normandie
- Coutances Tourism
This listing is free of charge for inclusion in the promotional material of Attitude Manche and the CRT, but a charge may be made for inclusion in the promotional material of certain tourist information offices. The purpose of this document is to detail the conditions of use of your data, the rights and duties of Attitude Manche and the Tourist Offices, as well as those of the information suppliers, i.e. the tourism service providers.
1. PURPOSE OF THE GCU
These SIT50 General Terms and Conditions of Use (hereinafter referred to as the “GTCU”) apply to any person working in the field of tourism.working in connection with the tourism industry and providing information to the SIT50 (hereinafter referred to as the “Information Provider”). The GCU define the procedures, rules, rights and obligations to be followed by each Information Provider.
2. ACCEPTANCE OF THE GCU
By accepting the GCU, each Information Provider accepts the integration (by input or implementation) of its information, personal data and content into the SIT50. These elements are made available to the SIT50 Network and/or distributed to users outside the SIT50 Network free of charge. They may also be distributed on any medium and for any type of use by any person accessing the SIT50. The Information Supplier accepts that the information it enters in the SIT50 may be reused within the framework of the article of the GCU relating to the dissemination of information.
3. COORDINATION OF SIT50
At departmental level, Attitude Manche coordinates the SIT50. As such, it is responsible for the system.
At the level of the Granville Terre et Mer inter-municipal area, it is the Office de Tourisme Granville Terre et Mer which validates the SIT50 data.
You can send your requests for modification/rectification/deletion of information to OT Granville Terre et Mer by telephone on 02 33 91 30 03. This is referred to hereafter as the “SIT 50 Contact”.
4. PROCESSING OF INFORMATION BY THE SIT50 NETWORK
Directly or indirectly, the SIT50 Contact has the means to query the Information Provider via :
- The VIT (Your Tourist Information) extranet space; filled in directly by the Information Supplier, the information is validated by the SIT50 Contact or by the Information Supplier’s reference Tourist Office, from among the 6 listed in the preamble.
- An e-mail with a link to a blank web questionnaire or one that has been pre-filled when updated; filled in directly by the Information Provider, it is validated by the SIT50 Contact or by the reference Tourist Office.
- A paper questionnaire (for Information Providers who do not have an e-mail address), sent by post and completed directly by the Information Provider; the SIT50 Contact or the reference TO enters the responses into the SIT50.
All information is provided freely by the Information Supplier and, as such, he is solely and entirely responsible for its quality and completeness. Attitude Manche and the Tourist Offices reserve the right to choose the means of disseminating this information, particularly to the general public, according to its quality and completeness and their own publication rules.
The Information Supplier is obliged to update, update and keep up to date the information it inserts in the SIT50.
The SIT50 Contact or the reference TO will pay attention to these updates. Any updated offer must, as a minimum, be updated with its opening dates, prices and contact details for the current year and for the following year from September onwards. Any offer that does not contain these updates may not be distributed to the general public, or may no longer be distributed. While taking into account the wishes of the Information Supplier, both the SIT50 Contact and the Tourist Offices providing this information may adapt each commercial description according to the situation, for reasons of editorial choice and to meet different needs, particularly in terms of internet referencing. These changes may be of form or substance, partial or total. The Information Provider may discuss these changes with the SIT50 Contact at any time. The SIT50 Contact reserves the right to contact the Information Provider and/or to make direct changes to any offer that contains errors of form. This applies in particular to spelling, the editorial quality of commercial descriptions, geolocation data and the translation of information. Both the SIT50 Contact and the Tourist Offices may add their own iconography, in particular photos and videos, to any offer made by the Information Supplier. The latter may discuss this with the SIT50 Contact at any time. For technical reasons, there may be a delay between the time the information is entered and the time it is put online on the various websites.
5. DISSEMINATION OF INFORMATION FROM THE SIT50
a. Principle of free dissemination of information
Information produced by SIT50 is intended to promote and develop tourism in La Manche. Consequently, this information is made available to tourism professionals and to the general public (tourists, web surfers, etc.) as well as to Attitude Manche’s institutional and private partners.
b. Distribution on the media of the Tourist Offices of La Manche
Each Information Supplier authorises its reference Tourist Office to distribute its information freely and without charge on all the media it produces, whatever the format. This applies in particular to
- Paper brochures
- Websites and mobile applications.
Depending on requirements, the Tourist Offices and Attitude Manche reserve the right to make editorial selections of data, in particular according to the completeness and updating of the information provided.
c. Refusal to distribute information to the general public
Any information provider who does not wish the information it provides to the SIT50 to be reused for the general public must clearly inform the SIT50 Contact. They may also choose to be distributed only on the media of SIT50 Network Members and not on those of SIT50 Network partners. Otherwise, and with the exception of personal data, all information may be re-used by any person having access to the SIT50.
6. PERSONAL DATA
The information entered in the SIT50 includes personal data relating to Information Suppliers. This personal data includes, for example, the surname, first name, e-mail address and telephone number of the Information Supplier, which may be made public. The Information Supplier agrees to the dissemination of personal data concerning him/her within the limits stipulated below. In accordance with the French Data Protection Act of 6 January 1978 and the General Data Protection Regulation (RGPD), all data contained in the SIT50 that identifies the Information Provider is treated as confidential.es present in the SIT50 and identified as being of a personal nature are subject to restrictions concerning their distribution and availability. In relation to such data, each data subject has a right of access, to object to processing, to rectification and to deletion on legitimate grounds. These rights may be exercised by contacting SIT50. The retention period for personal data collected is strictly limited to the purposes for which it was collected. The retention period for the said data does not exceed the period necessary for the purposes for which they are collected and processed. The said data is regularly updated. All provisions relating to personal data are set out in our privacy policy.
7. COMMITMENTS OF THE SIT50 NETWORK
When modifying information, Network Members are not authorised to distort and/or alter it. At any time, the Information Provider may ask its SIT50 Contact/Reference TPO or proceed by its own means to :
- Update its information.
- Correct errors and/or gaps in its information.
- Delete information that has become obsolete or is not up to date.
In the context of the article relating to the operation of the SIT50 Network, at the request of the Information Provider and as soon as possible, the Members of the SIT50 Network undertake to correct any errors, gaps and/or unsatisfactory information.
8. RIGHTS AND UNDERTAKINGS OF THE INFORMATION PROVIDER
a. Rights of the Information Supplier
At any time, the Information Provider may ask its SIT50 Contact or its reference TO for:
- Update its information.
- The correction of errors and/or omissions in their information.
- The deletion of information that has become obsolete or is not up to date.
The Information Provider may ask the SIT50 Contact or its reference TO that its information not be published:
- In all media published by the Tourist Offices, Attitude Manche and the CRT
- In all media published by partner distributors, a list of which is available here: https: //pronormandietourisme.fr/outils/la-base-de-donnees/nos-partenaires-diffuseurs/
The internet and mobile sites of SIT50 Network Members containing information from SIT50 are likely to contain opinions emanating directly from users of the said sites. The information provider is therefore entitled to ask the SIT50 Contact for assistance in responding to an opinion.
b. Commitments of the Information Provider
The Information Provider guarantees the SIT50 Network and its SIT50 Contact that it carries out its activities in compliance with the laws, rules and authorisations required of it. Neither the SIT50 Network nor the SIT50 Contact/reference TO may under any circumstances be held liable for any failure on the part of the Information Supplier.
c. Conditions of access and opening of activities
The Information Provider must provide correct and up-to-date access conditions and opening days and times for its activities.
d. Integration of elements
As part of the information provided, the Information Provider may transmit texts, spreadsheets, photographs, videos, graphics, figures, logos, PDF documents and any other data that may provide information for the purpose of promoting its activities and tourism (making the customer want to come and all the practical information needed to do so). In order to facilitate the integration of information into the SIT50, the Information Supplier is asked to comply with the input rules communicated to him.
e. Conformity of elements
The Information Supplier shall do everything in its power to use hardware and software free of any malicious software solutions. The same applies to the supply of information and computer files.
9. GEOLOCATION DATA
The geolocation data contained in the SIT50 is automatically generated using IT tools provided by GoogleMapsTM. As such, the SIT50 Network cannot be held responsible for any approximation or error in the geolocation of any location. The SIT50 Network reserves the right to make changes to any geolocation data relating to any Information Provider. The Information Provider is entitled to request changes to the geolocation data from its SIT50 Contact or its reference EO.
10. PROPERTY RIGHTS
All information and elements transmitted by the Information Supplier are and remain its full, entire and exclusive property. For the benefit of the SIT50 Network, its Members and its partners, the Information Provider grants, free of charge, authorisation to use and re-use said information and said elements. These rights are granted for all types of use, on all types of media, throughout the world and for the entire legal term of protection of property rights. This concerns in particular the rights of reproduction, representation, destination and re-use of said information and said elements.
With regard to the right to the name of the Information Supplier, in the event of any use or re-use of an intellectual work, the Members of the SIT50 Network undertake to indicate the name of the owner of the said work, provided that such information is available. In the event of omission, the Information Provider is entitled to demand that its right to the name be respected. This also applies in the event of errors or inaccuracies. In the interests of the Information Provider as much as for technical and/or formatting requirements, the Information Provider authorises SIT50 Network Members to make modifications and improvements to any intellectual work that it has implemented within SIT50.
11. MISCELLANEOUS
a. Modification of the GCU
Only the SIT50 Technical Committee is entitled to modify the GCU. The GTCU may be modified at any time, particularly in the event of technical, legal or jurisprudential developments or when new services are introduced. The Information Provider is therefore invited to regularly consult the latest updated version of the GTCU. On the date they are put online, the amended GCU are applicable to any person accessing the SIT50.
b. Disputes
Any conflict or dispute that may arise with regard to the interpretation and/or application of the GTUs that cannot be resolved amicably is automatically subject to the jurisdiction of the Coutances Commercial Court.
c. Nullity
If any one of the stipulations of the GCU is declared null and void or unwritten, the other stipulations shall remain in full force and effect. In this respect, the SIT50 Technical Committee reserves the right to amend any invalid or unwritten provision of the GCU.
d. Applicable law
The GCU are subject to French law, which is the only law applicable in this respect. The GCU are drawn up in French, the only language applicable in this respect.
