ARTICLE 1: DEFINITIONS

2.5 Customer capacity
All Customers declare that they have the legal capacity, in accordance with article 1124 of the French Civil Code, to contract and use the Website in accordance with the General Terms and Conditions of Sale and Use of the Website.

ARTICLE 3: FORMATION OF THE CONTRACT

3.1 Via the website
3.1.1 Reservations can be made by the user on the https:// www.tourisme-granville-terre-mer.com website.
3.1.2 The user selects the day of the event offered online, either Saturday 1 or Sunday 2 October 2022.
3.1.3 A summary is then sent to the user, showing the choice made and the price of the total amount of the booking, with an indication of the method of payment chosen by the user.
3.1.4 In application of the provisions of article 1369-5 of the French Civil Code, this first click allows the user to check the details of their booking and the total price of the booking, and to rectify any errors before the final booking is recorded.
3.1.5 The booking is only recorded and the contract deemed to have been formed once the booking has been confirmed by the user’s second click.
3.1.6 In application of the provisions of article 1369-5 paragraph 2 of the French Civil Code, a confirmation email will be sent to the user, acknowledging receipt of the booking sent to the company.
3.1.7 Keeping and printing the confirmation email will enable the customer to provide proof that the booking has been made with OFFICE DE TOURISME GRANVILLE TERRE ET MER.
3.1.8 The company OFFICE DE TOURISME GRANVILLE TERRE ET MER wishes to point out that in the case of payment by bank card, the contract will only be considered definitively concluded subject to acceptance of payment by the customer’s bank.

ARTICLE 4: PRICES AND TERMS OF PAYMENT

4.1 Prices are quoted in Euros, inclusive of tax, and are those in force on the day of booking.
4.2 Activities are subject to VAT at the current rate.
4.3 The user may choose to pay by credit card.
4.4 Payment by credit card may be made by Carte Bleue, Visa, Eurocard/Mastercard or Maestro.
4.5 In the case of an online purchase of an activity, the customer must indicate the bank card number, its date of validity and the security pictogram on the back of the bank card in the area provided for this purpose.
4.6 This method of payment will result in the immediate debiting, on the day the booking is made, of the full amount or a deposit of the amount of the booking.
4.7 In the event of non-payment or refusal of authorisation by the customer’s bank, OFFICE DE TOURISME GRANVILLE TERRE ET MER will be entitled to suspend the booking process.
4.9 If the customer has a Paypal account, if the customer chooses to pay by credit card, the customer will be able to pay via their Paypal account.
If the customer does not have a Paypal account, they will be asked to create one by following the instructions sent to them.

ARTICLE 5: PROOF OF RESERVATIONS

5.1 The data recorded in the databases of the OFFICE DE TOURISME GRANVILLE TERRE ET MER company constitutes proof of the reservations made, subject to an obvious material error for which it is the responsibility of the customer to provide proof.
5.2 Data relating to bookings made constitute accepted and opposable forms of proof under the same conditions as documents drawn up in writing.

ARTICLE 6: PAYMENT SECURITY

6.1 Activity bookings are subject to regular checks. The correct operation of these checks may force the company OFFICE DE TOURISME GRANVILLE TERRE ET MER to suspend the booking process and to ask the user to provide proof, such as proof of address, identity or debit, which must be in accordance with the information entered by the user.These documents must match the information entered by the user when the booking was made, as well as the details of the holder of the bank card used, the billing details entered when the booking was made and, where applicable, the details of the holder of the payment card used.
6.2 The information collected during these checks may be subject to automated data processing, in order to define a level of transaction security and to combat credit card fraud.

ARTICLE 7: TRANSFER OF OWNERSHIP/TRANSFER OF RISK
The delivery of the activities to the customer will result in the transfer of ownership and risks.

ARTICLE 8: NON-COMPLIANCE

8.1 Any error relating to the activity ordered must be reported by the customer, by letter or e-mail (contact section of the site), within 72 hours of the date of receipt of the reservation.
8.2 Complaints that are not made in accordance with the conditions stipulated in this article will not be taken into account and will under no circumstances give rise to any claims by the OFFICE DE TOURISME GRANVILLE TERRE ET MER against the customer.

ARTICLE 9: CONDITIONS OF USE OF THE ACTIVITY

9.1 The general conditions of sale must be brought to the attention of the beneficiary of the activity. If necessary, the customer will be responsible for providing this information.
9.2 The possibility of benefiting from a service is subject to the prior presentation of the confirmation email, for the activity purchased online.
9.3 The visual of the event presented online is not contractual, and any reproduction, in whole or in part, is prohibited.
9.4 The provision of the Event is subject to the specific conditions of the company OFFICE DE TOURISME GRANVILLE TERRE ET MER, particularly in terms of cancellation or modification of the booking, age limits and the physical conditions of the Beneficiary or Beneficiaries.

All orders are therefore legally considered to be firm and definitive. A ticket cannot be reimbursed, even in the event of loss or theft, nor can it be taken back or exchanged. There are only two cases in which a refund may be made: – The event is cancelled or substantially modified – The organiser authorises the refund and makes the funds available for the refund. Refunds will only be made to the original purchaser. No costs of any kind will be refunded or compensated. Any decision to cancel, postpone or modify an event is the sole responsibility of the Organiser.

ARTICLE 11: CUSTOMER SERVICE – COMPLAINTS

Any request for information or clarification, particularly relating to the purchase, refund, exchange or operation of activities, must be addressed to the company OFFICE DE TOURISME GRANVILLE TERRE ET MER by email: administration@otgtm.fr or by post: 2 rue Lecampion 50400 Granville.

ARTICLE 12: PERSONAL DATA

12.4 Pursuant to the provisions of the French Data Protection Act no. 78-17 of 6 January 1978, as amended, customers have the right to access, rectify and delete personal data and the right to object to the use of such data.

13.2 The automatic liability provided for in the aforementioned article L. 211-16 is excluded, in accordance with article L. 211-17 of the French Tourism Code.
13.3 Unless there are legal provisions to the contrary, the company OFFICE DE TOURISME GRANVILLE TERRE ET MER may under no circumstances be held liable in the event of damage caused by the Customer.

ARTICLE 14: INDEPENDENCE OF CONTRACTUAL CLAUSES

In the event of one of the present provisions being declared null and void or deemed unwritten, the validity of the other provisions of the General Terms and Conditions of Sale will not be affected.

ARTICLE 15: INSURANCE

The company OFFICE DE TOURISME GRANVILLE TERRE ET MER has taken out civil and professional liability insurance which covers, in particular, the financial consequences that may befall the insured party as a result of bodily injury, material and immaterial damage caused to the Beneficiary as a result of faults, errors of fact or of law, omissions or negligence committed in the course of its activity as an activity issuer.

ARTICLE 16: APPLICABLE LAW

The law applicable to the General Terms and Conditions of Sale and the contract concluded at the time of booking an activity is French law for all disputes relating, in particular, to their validity, interpretation, performance or termination.

ARTICLE 17: COMPETENT JURISDICTION (SETTLEMENT OF DISPUTES)

The competent court in the event of a dispute shall be that, at the choice of the plaintiff, of the domicile of the defendant, or of the place of actual delivery of the Product.
